Terms and Conditions of Purchase

Tierra Diamond was officially established in May 2016 with the goal of providing Vietnamese customers the opportunity to own high-quality natural diamond jewelry at reasonable prices.
In the context of the 'shadowy and bright' landscape of the domestic diamond market—where numerous individuals and entities participate with varying quality standards and prices—we have witnessed many consumers suffering disadvantages due to purchasing based on intuition, word of mouth, or sales pitches.
Therefore, alongside the most important factor, product quality, Tierra is committed to sharing truthful information and accurate knowledge about natural diamonds with the public, helping each customer confidently make informed decisions and achieve maximum benefits. We believe that with our efforts, the market will become increasingly standardized and transparent, making it easier to own natural diamonds.
We pursue a 'Click & Brick' model—combining the strengths of online platforms and physical stores with the aim of making diamond jewelry and the shopping experience truly enjoyable and exceptional for modern, sophisticated customers with high demands.

  1. Quality Natural Diamonds
    • We ensure thorough screening and certification before any diamond is sold. In addition to commonly considered factors like Carat, Color, and Clarity, we place particular emphasis on Cut, Fluorescence, and Symmetry to guarantee high Brilliance and Fire.
    • All Tierra diamonds (4.00 mm and above) are certified by GIA – Gemological Institute of America, with an inscription on the diamond for verification. For non-GIA certified diamonds or synthetic diamonds (only upon special request), clear information will be provided on the Guarantee Certificate.
    • For tablet diamonds, we use only the highest quality diamonds (D-E-F/VVS) matching the quality of the center stone. Synthetic diamonds or other gemstones will only be used under special customer requests with clear notes on the Guarantee Certificate, reflecting the price adjustment accordingly.
    • Tierra Diamonds comply with the Kimberley Process to ensure conflict-free, ethically sourced diamonds.
  2. Correct Gold Purity
    • We craft and provide jewelry in 24k, 18k, 14k, and 10k gold with an absolute commitment to purity.
    • Any deviations from standard purity (only upon customer request) will be clearly noted on the Guarantee Certificate.
  3. Transparent Information
    • We ensure that all technical specifications of the product (weight, gold purity, number & size of tablet diamonds, 4C standards, etc.) are clearly and transparently stated on the Guarantee Certificate.
    • Customers have the right to request verification of these specifications before receiving and paying for the goods (additional costs for special verification requests outside Tierra Diamond's standard procedures will be borne by the customer).
  4. Customer Responsibility
    • We offer the most attractive exchange policy for all products sold (except special cases agreed upon separately with the customer and noted on the Guarantee Certificate).
    • As a commitment to craftsmanship quality, we provide LIFETIME WARRANTY & FREE REPAIR for ring bands and tablet diamonds under 2.0 mm (excluding damages from impact, high temperatures, corrosive chemicals, or other exceptions outlined in the Disclaimer). Additionally, Tierra Diamond jewelry is eligible for free inspection, cleaning, and refurbishment every 6 months.
  5. Sustainable Development
    • We pursue sustainable development with core values of HONESTY, FAIRNESS, and RESPONSIBILITY. These values are reflected in our relationships with customers, employees, partners, and the community.
    • We ensure the development of employees’ income, living standards, and working conditions through suitable facilities, regular training, full legal benefits, and performance-based rewards.

  1. Purchase at the Store
    • Tierra Diamond's office is open from 9:00 AM to 8:00 PM, Monday through Saturday (excluding public holidays or special cases, which will be announced on our website and official Facebook page)
    • Due to our 1:1 consultation model, which emphasizes privacy and comfort, we encourage customers to make an appointment in advance and call the consultant 30 minutes before arriving at the store for the best possible service.
    • For in-store purchases, customers are required to pay 100% of the amount before we make any adjustments (e.g., resizing rings, setting stones, etc.). If the adjustments can be completed within 60 minutes, we will prioritize them so you can receive your items immediately. For adjustments requiring more time, customers will be scheduled to pick up their items the following day.
  2. Online Purchase
    • You can purchase Tierra Diamond products online through our website or Tierra Diamond's Facebook page.
    • During working hours from 9:00 AM to 8:00 PM, Tierra staff will ensure that customer inquiries are responded to within 30 minutes of receipt.
    • To receive accurate pricing and find the desired product, customers need to provide the correct ring size. Tierra Diamond staff will guide you on how to measure or assist with sending a ring sizing tool if needed (for customers who have made a deposit).
    • In all cases, we only ship after receiving 100% payment for the order.
  3. Custom Design Ordering Policy
    • When placing a custom order, customers are required to pay a deposit of 20% of the product value and the remaining 80% on the day of delivery.
    • We will provide a quote based on estimated product specifications. After creating the design, 3D model, and precise calculations, we will notify you of any price adjustments based on the actual specifications.
    • Prices are quoted/posted per item. Tierra is not responsible for breaking down the product price into individual components such as gold, diamonds, labor, design, etc.
    • Tierra Diamond will support creating a product sample and sending 3D images for customer approval before production. Customers can request design changes, but only up to 2 times. Once the design is approved, we will proceed with manufacturing. From this point, customers will bear any additional costs if changes are made to the approved design.
    • The standard time from order placement to delivery is 20 days. This time may vary depending on the complexity of the design and the GIA certification of the center stone. Tierra Diamond staff will inform you of any changes to the delivery time compared to the standard time.
    • In cases of design changes after sample approval or extended design discussions, the delivery time may be delayed beyond the standard time but not more than 10 days from the final design approval
    • If customers need custom designs in less than 20 days, please discuss with Tierra Diamond staff for assistance. We will assess feasibility and support customers to the best of our ability. However, Tierra Diamond may refuse assistance if conditions do not allow or additional costs may apply.
  4. Delivery Policy
    • Due to the high value of the goods, Tierra does not support COD (Cash on Delivery) services. We only ship goods after receiving 100% payment.
    • We encourage customers to pick up their orders in-store for the best inspection conditions and quick adjustments if needed.
    • If requested, we offer free delivery within a 10km radius in Ho Chi Minh City via Grab Delivery and express delivery for other provinces. However, Tierra Diamond is not responsible for any damage or loss occurring during the shipping process.
    • When using delivery services, Tierra Diamond will perform inspection steps such as "Goods Inspection Rules" and provide video footage if requested. We do not support home or third-party inspections.
  5. Goods Inspection Rules Upon Receipt
    • When receiving the goods, we encourage customers to carefully check and confirm the following:
      1. Diamonds:
        • Test the diamond with a diamond tester.
        • Cross-check the GIA certificate number and the laser inscription on the diamond using a loupe.
        • Inspect the diamond’s quality with a loupe, if requested.
      2. Jewelry:
        • Ensure the ring size fits comfortably and is wearable.
        • Check Tierra’s hallmark on the product, including "TIERRA," the LOGO, and GOLD PURITY.
        • Visually inspect the jewelry for a smooth surface, absence of scratches or defects, even plating color, symmetry, aesthetics, and engraving details.
        • Test the small diamonds with a diamond tester.
        • Center Stone and Setting:
          • Verify that the center diamond is set accurately, with a flat table and no tilt.
          • Ensure that prongs are secure and the diamond does not wobble.
          • Check that prong grooves are deep enough to securely hold the diamond.
          • Ensure that prongs and setting are not broken or deformed under normal handling.
        • Documents:
          • Verify the Tierra Diamond Guarantee Certificate for accurate product details, including images, name, phone number, and Tierra Diamond’s seal.
          • Check the GIA certificate to ensure it matches the diamond’s inscription number. The GIA certificate must be laminated and free from any signs of tampering.
    • After confirming these factors, customers can proceed with payment. By making the payment, customers acknowledge that they have received the product in full and in the described quality.
    • Any questions or issues after receiving the product will be addressed according to Tierra Diamond’s Warranty & Exchange Policy.

We accept various payment methods, including cash, bank transfer, card payments, QR code payments, and credit card installment payments.

  1. Cash Payment:
    • We only accept payments in Vietnamese Dong (VND) as per government regulations
    • We reserve the right to refuse cash if we suspect any note is counterfeit, damaged, or of unclear origin.
  2. Bank Transfer:
    • Payment is considered successful only when the bank confirms that Tierra Diamond has received the funds.
    • Customers are responsible for any fees related to bank transfers.
  3. Card Payment:
    • We accept credit cards from VISA, MASTER, JCB/CUP, and domestic ATM/Napas cards.
    • We may request additional information such as full name, ID card/passport number, address, and phone number for verification purposes if necessary.
    • For foreign cardholders, presenting a passport and verifying the cardholder's identity is mandatory. If the credit card is issued outside Vietnam, we may require a copy of the passport for verification with the bank in case of international transaction issues (see our Privacy Policy for more details).
    • We reserve the right to refuse payment with cards if the cardholder is not the actual cardholder or in any case of suspected fraud or deception.
    • For jewelry packaging products, Tierra will cover card processing fees. For GIA-certified diamonds, customers will incur a 2% payment fee on the transaction amount as per the bank's and payment service providers' policies.
  4. Credit Card Installments:
    • Tierra offers installment payment options through VISA/MASTER/JCB credit cards in partnership with Micro Technology Joint Stock Company (mPOS.vn).
    • Details about fees, interest rates, and installment procedures will be provided by Tierra staff based on mPOS.vn's policies.

Note: Payment methods through cards, QR codes, and installments are processed through partner payment services (currently mPOS.vn). Therefore, payment policies and fees may change based on the partner's policies.

Tierra Diamond categorizes its products into five groups:

  • Group 1: Natural Round Brilliant Cut Diamonds (GIA certified)
  • Group 2: Natural Fancy Shape and Fancy Color Diamonds (GIA certified)
  • Group 3: Natural Diamond Jewelry in 14K and 18K gold
  • Group 4: CZ Jewelry in 14K and 18K gold

    • Natural Diamond Jewelry in Platinum900 and made-to-order Natural Diamond Jewelry in Platinum900

Notes:

  • The exchange value is calculated as the purchase price minus any applied discounts. Tierra Diamond will record the specific exchange value on the Guarantee Certificate.
  • In some cases (e.g., when customers request non-refundable purchases at special prices), Tierra will not guarantee exchanges, and this will be clearly stated on the Guarantee Certificate. For such orders, Tierra will only assist with consignment and resale if the customer requests it.
  • Return & Exchange Timeframe and Procedure:
    • The above exchange policy applies from May 10, 2022. For orders placed before this date, the return and exchange policy will follow the commitment stated on the Guarantee Certificate at the time of purchase.
    • If you wish to return or exchange a product, please contact Tierra Diamond via hotline or Facebook to get advice and schedule an appointment.
    • Returns and exchanges can only be processed directly at Tierra Diamond's offices: Ho Chi Minh City Branch: 3rd Floor, 168 Vo Thi Sau, P.8, District 3, Ho Chi Minh City, Dong Nai Branch: 1080 Pham Van Thuan, P. Tan Mai, Bien Hoa City, Hanoi Branch: 5 Truc Bach, Ba Dinh, Hanoi.
    • When visiting the office, customers must bring the product along with all necessary documents including the Guarantee Certificate, GIA Certification (for GIA-certified diamonds), and identification (ID card or passport).
    • Tierra Diamond will only process returns and exchanges in the afternoon from 13:00 to 18:00, Monday to Friday each week. Outside these hours, we will accept requests and address them on the next working day.

Tierra will only accept returns and exchanges if the customer retains all documents, including the Guarantee Certificate, GIA Certification (for GIA-certified diamonds), and if the product is intact, not damaged, chipped, deformed, or cracked

  • If the Guarantee Certificate is lost, Tierra will assist in tracing and verifying with stored data. If we confirm the order information, we will support the return or exchange according to the policy.
  • If the GIA certification for the diamond is lost, we reserve the right to refuse the return or exchange or only do so at a negotiated price.
  • Tierra will refuse returns or exchanges for diamonds that are cracked, chipped, scratched, or show signs of being affected by heat, pressure, chemicals, etc., leading to potential changes in the diamond’s original quality.
  • For jewelry that is cracked, deformed, or damaged, we will only support returns based on the actual gold value after reweighing the product. Tierra reserves the right to refuse returns or exchanges if the jewelry or diamond has been modified, resized, plated, or polished by a third party not affiliated with Tierra Diamond
  • We may refuse returns or exchanges if the requester differs from the original buyer and the product shows signs of fraud or illegal activities.

Payment for exchange value will be made in cash or bank transfer, depending on Tierra Diamond’s decision. Payment will be completed within a maximum of 36 hours from the time all checks are completed and the exchange is approved.

Exchanges may be suspended in cases of force majeure such as war, terrorism, epidemics, natural disasters, earthquakes, tsunamis, or when the government declares a state of emergency, curfew, or martial law.

Tierra applies a lifetime warranty policy for Tierra Diamond jewelry products with the following terms:

Tierra encourages customers to visit the Tierra Diamond office for warranty service and product inspection every 6 months to ensure the product remains in the best condition, minimizing the risk of major damage or loss of the main stone

Please bring the Warranty Certificate when visiting for inspection and warranty service.

For warranty services that can be completed within 30 minutes, we will prioritize immediate service for customers. For services requiring more time, Tierra will provide a collection date. Typically, warranty service is completed within 3 business days, except during peak seasons or public holidays

Note: Upon receiving the repaired product, we encourage customers to inspect it according to the “Goods Inspection Rules Upon Receipt” detailed in section 5 of the “Purchase Policy.”

Tierra reserves the right to refuse warranty service for products that show signs of alteration, tampering, or modifications by any third party not affiliated with Tierra Diamond.

Protecting consumers' personal information and building trust is very important to us. Therefore, we will use your name and other related information in accordance with this policy.

We only collect necessary information related to the transaction.

  • Consumers or Customers will be required to provide complete information in the fields provided on the Website: Tierra.vn or the Warranty Certificate, such as: Full Name, address (home or office), email address (company or personal), phone number (mobile, home or office), credit card details (type and number of the credit card, CVC code, expiration date, cardholder's name) and a copy of ID card/Passport if necessary. This information is required to complete the order and record it on the Warranty Certificate, and for order tracking, returns, and future warranty services.

  • Đèn báo hiệu web: Là các sợi mã phần mềm nhỏ tượng trưng cho yêu cầu về hình ảnh đồ thị trên 1 trang web hay email. Nó có thể có hoặc không có hình ảnh đồ thị nhìn thấy được liên quan đến đèn báo hiệu web, và thông thường hình ảnh được thiết kế để trộn lẫn vào nền của trang web hoặc email.   1. Mục đích thu thập thông tin người dùng

    Cung cấp dịch vụ cho Khách hàng và quản lý, sử dụng thông tin cá nhân của Người Tiêu Dùng nhằm mục đích quản lý cơ sở dữ liệu về Người Tiêu Dùng và kịp thời xử lý các tình huống phát sinh (nếu có).

  2. Phạm vi sử dụng thông tin cá nhân

    Website Tierra.vn & Tierra Diamond sử dụng thông tin của Người Tiêu Dùng cung cấp để:

    • Cung cấp các dịch vụ đến Người Tiêu Dùng
    • Gửi các thông báo về các hoạt động trao đổi thông tin giữa Người Tiêu Dùng và Tierra
    • Ngăn ngừa các hoạt động phá hủy, chiếm đoạt tài khoản người dùng của Người Tiêu Dùng hoặc các hoạt động giả mạo Người Tiêu Dùng
    • Liên lạc và giải quyết khiếu nại với Người Tiêu Dùng
    • Xác nhận và trao đổi thông tin về giao dịch của Người Tiêu Dùng tại Tierra
    • Trong trường hợp có yêu cầu của cơ quan quản lý nhà nước có thẩm quyền
  3. Thời gian lưu trữ thông tin cá nhân

    Không có thời hạn ngoại trừ trường hợp Người Tiêu Dùng gửi có yêu cầu hủy bỏ tới cho Ban quản trị hoặc Công ty giải thể hoặc bị phá sản.

  4. Những người hoặc tổ chức có thể tiếp cận thông tin cá nhân của người dùng

    Người Tiêu Dùng đồng ý rằng, trong trường hợp cần thiết, các cơ quan/ tổ chức/cá nhân sau có quyền được tiếp cận và thu thập các thông tin cá nhân của mình, bao gồm:

    • Ban quản trị
    • Bên thứ ba có dịch vụ tích hợp với Website Tierra.vn
    • Công ty tổ chức sự kiện và nhà tài trợ
    • Cơ quan nhà nước có thẩm quyền trong trường hợp có yêu cầu theo quy định tại quy chế hoạt động
    • Công ty nghiên cứu thị trường
    • Cố vấn tài chính, pháp lý và Công ty kiểm toán
    • Bên khiếu nại chứng minh được hành vi vi phạm của Người Tiêu Dùng
    • Theo yêu cầu của cơ quan nhà nước có thẩm quyền
  5. Cam kết bảo mật Thông tin Cá nhân của Người Tiêu Dùng

    Thông tin cá nhân của Người Tiêu Dùng tại Tierra Diamond được Ban quản trị cam kết bảo mật tuyệt đối theo chính sách bảo mật thông tin cá nhân được đăng tải trên website Tierra.vn. Việc thu thập và sử dụng thông tin của mỗi Người Tiêu Dùng chỉ được thực hiện khi có sự đồng ý của Người Tiêu Dùng trừ những trường hợp pháp luật có quy định khác và quy định này.

    Không sử dụng, không chuyển giao, cung cấp hoặc tiết lộ cho bên thứ 3 về thông tin cá nhân của Người Tiêu Dùng khi không có sự đồng ý của Người Tiêu Dùng ngoại trừ các trường hợp được quy định tại quy định này hoặc quy định của pháp luật.

    Trong trường hợp máy chủ lưu trữ thông tin bị hacker tấn công dẫn đến mất mát dữ liệu cá nhân của Người Tiêu Dùng, Ban quản trị có trách nhiệm thông báo và làm việc với cơ quan chức năng điều tra và xử lý kịp thời, đồng thời thông báo cho Người Tiêu Dùng được biết về vụ việc.

    Bảo mật tuyệt đối mọi thông tin giao dịch trực tuyến của Người Tiêu Dùng bao gồm thông tin hóa đơn kế toán chứng từ số hóa tại khu vực dữ liệu trung tâm an toàn cấp 1 của Tierra Diamond.

  6. Cơ chế tiếp nhận và yêu cầu khiếu nại sai phạm về Bảo vệ Thông tin cá nhân

    Khi phát hiện thông tin cá nhân của mình bị sử dụng sai mục đích hoặc phạm vi, Người Tiêu Dùng gửi email khiếu nại đến email support@uat1.tierra.vn để khiếu nại và cung cấp chứng cứ liên quan tới vụ việc cho Ban quản trị. Ban quản trị cam kết sẽ phản hồi ngay lập tức hoặc muộn nhất là trong vòng 24 (hai mươi tư) giờ làm việc kể từ thời điểm nhận được khiếu nại.

Kim cương Thiên nhiên và Trang sức kim cương là Tài sản quý giá. Vì vậy quý khách phải sử dụng nâng niu và nhẹ nhàng

  • Đối với kim cương
    • Mặc dù Kim cương Thiên nhiên là vật liệu cứng nhất trong tất cả các loại đá quý nhưng vẫn có thể bị trầy xước, nứt mẻ trong quá trình sử dụng, đặc biệt khi để va đập, cọ xát với viên kim cương khác
    • Không đeo những sản phẩm Kim cương có ổ chấu cao gần nhau vì Kim cương va chạm vào nhau sẽ gây trầy xước.
    • Đặc biệt với kim cương có độ tinh khiết FL (Flawless – không tì vết cả bên trong và bên ngoài) và IF (Internal Flawless – không tì vết bên trong và chỉ có tì vết rất nhỏ bên ngoài): quý khách phải cực kì cẩn thận khi sử dụng và bảo quản vì chỉ cần một vết xước cũng có thể làm giảm cấp độ và giá trị của viên kim cương, ảnh hưởng đến việc mua bán & thu đổi về sau
    • Luôn bảo quản và cất giữ giấy kiểm định GIA ở nơi an toàn, không để bị thấm nước, rách, nhàu nát, bụi bẩn.
  • Đối với Trang sức
    • Làm sạch trang sức thường xuyên chỉ cần với chút nước ấm, một miếng vải mềm hoặc bàn chải lông mềm. Cho những vết bẩn cứng đầu, ngâm trang sức trong nước từ 3-4 phút trước khi rửa lại dưới vòi nước đang mở.
    • Nhẹ nhàng tháo món trang sức thân yêu trước khi tiếp xúc với bất kỳ hóa chất từ nước hoa, mỹ phẩm, sữa tắm, thuốc nhuộm tóc, đến nước rửa chén, lau sàn, đến chlorine (chất khử trùng hồ bơi)… Đặc biệt, bạn không nên đeo trang sức trong khi tắm hay khi xịt nước hoa.
    • Tránh để trang sức tiếp xúc lâu với ánh nắng & nhiệt độ cao – những tác nhân không hề “thân thiện” có thể ảnh hưởng đến màu, độ sáng, độ bóng của trang sức.
    • Cẩn thận cất mỗi món trang sức trong các ngăn riêng, có lót vải mềm để tránh va đập lần nhau gây trầy xước.
    • Đừng đeo trang sức khi vận động mạnh (tập thể dục, thể thao), làm việc nặng (dọn nhà, làm vườn…) vì mồ hôi và bụi bẩn có thể bám vào & làm trang sức mau cũ kỹ, phai màu. Ngoài ra, với trang sức có viên chủ lớn, ổ chấu cao, bạn cần cẩn thận để tránh va đập mạnh, vướng vào quần áo, … có thể dẫn đến tình trạng rơi mất viên.

  1. Phương pháp nộp thuế GTGT cho đơn vị kinh doanh vàng bạc đá quý:

Phương pháp nộp thuế giá trị gia tăng đối với đơn vị kinh doanh vàng bạc đá quý được quy định tại khoản 4 Điều 12 Thông tư 219/2013/TT-BTC (được sửa đổi bởi khoản 3 Điều 3 Thông tư 119/2014/TT-BTC) như sau:

Trường hợp cơ sở kinh doanh có hoạt động mua, bán, chế tác vàng, bạc, đá quý thì cơ sở kinh doanh phải hạch toán riêng hoạt động này để nộp thuế theo phương pháp tính trực tiếp trên giá trị gia tăng.

  1. Loại hóa đơn áp dụng cho đơn vị kinh doanh vàng bạc đá quý:

Căn cứ Điều 8 Nghị định 123/2020/NĐ-CP quy định về hóa đơn bán hàng là hóa đơn dành cho các tổ  chức, cá nhân như sau:

a) Tổ chức, cá nhân khai, tính thuế giá trị gia tăng theo phương pháp trực tiếp sử dụng cho các hoạt động:

– Bán hàng hóa, cung cấp dịch vụ trong nội địa;

– Hoạt động vận tải quốc tế;

– Xuất vào khu phi thuế quan và các trường hợp được coi như xuất khẩu;

– Xuất khẩu hàng hóa, cung cấp dịch vụ ra nước ngoài.

b) Tổ chức, cá nhân trong khu phi thuế quan khi bán hàng hóa, cung cấp dịch vụ vào nội địa và khi bán hàng hóa, cung ứng dịch vụ giữa các tổ chức, cá nhân trong khu phi thuế quan với nhau, xuất khẩu hàng hóa, cung cấp dịch vụ ra nước ngoài, trên hóa đơn ghi rõ “Dành cho tổ chức, cá nhân trong khu phi thuế quan”.

Do đó, đơn vị kinh doanh vàng bạc đá quý nộp thuế theo phương pháp tính trực tiếp trên giá trị gia tăng. Đơn vị này sẽ áp dụng hóa đơn bán hàng, giá bán bao gồm tiền bán vàng, bạc, đá quý và tiền công.
